Yes, the claims are striking. I recently published an article titled “Sam Altman didn’t need another lawsuit,” and the situation fits that description. Apple describes former employees soliciting confidential details during interviews, including requests to bring prototype hardware for demonstrations. Experts I spoke with said such tactics appear in many trade secrets cases, but rarely combined in one dispute involving two major players.

Apple has a history of testing intellectual property boundaries. In the 1990s it pursued copyright claims against Microsoft over interface similarities. Later it targeted Samsung with patent suits over Android devices. Those efforts did not halt competitors, yet they reshaped legal standards. Now Apple turns to trade secrets against OpenAI. The question is whether OpenAI can absorb the costs the way larger rivals once did.

Exactly. OpenAI is preparing for an IPO while investors scrutinize its path to profitability. A large settlement could strain resources at an already difficult moment. Attorneys I consulted expect a lengthy trial, though a negotiated resolution remains possible if both sides find acceptable terms.

Personal dynamics appear to play a role. Former Apple executive Tang Tan now serves as OpenAI’s chief hardware officer and is central to many allegations. Jony Ive, Apple’s celebrated former designer, is not named in the complaint despite his involvement with OpenAI’s hardware efforts.

Tang Tan spent 24 years at Apple, including as VP of the Apple Watch, before joining Ive’s company, which OpenAI later acquired. The suit portrays him as orchestrating much of the information gathering during interviews. Ive’s absence from the filing is notable; some observers suggest he may have maintained distance from day-to-day activities, while others point to his stature and connections.
