French court shortens Marine Le Pen office ban but imposes electronic monitoring

A French appeal court on Tuesday confirmed Marine Le Pen's conviction for misusing European Union funds yet reduced her prohibition from seeking public office, theoretically keeping open a route for the far-right leader to contest the 2027 presidential race.

Nevertheless, the court imposed a three-year prison sentence on Le Pen, with two years suspended and one year to be served under electronic ankle monitoring. This arrangement would create major political and practical obstacles for any presidential bid and raises questions about whether she will pursue the country's top post.

Le Pen has indicated reluctance to conduct a presidential campaign while subject to electronic monitoring, claiming it would hinder her ability to campaign effectively and weaken her position as a candidate. She has not yet clarified her intentions.

She is scheduled for a prime-time television interview on TF1 at 8 p.m., during which she could reveal her political plans.

Le Pen found guilty of embezzlement in 2025

In March 2025, Le Pen received a conviction for embezzlement along with a five-year ban, effective immediately, from holding public office, blocking her planned fourth attempt to reach the Elysee Palace.

The appeal ruling renders Le Pen ineligible for public office for 45 months, with 30 months suspended. This structure allows her to stand in the April 2027 election, as she has already completed most of the 15-month active portion of the ban that began after last year's decision.

Yet the fresh prison term, to be served via electronic tag, could prove nearly as harmful as an outright prohibition.

Electronic monitoring could derail Le Pen presidential hopes

The ruling is expected to spark vigorous discussion inside her anti-immigration National Rally party, which has prepared for scenarios either with Le Pen at the helm or under party president Jordan Bardella.

Bardella, aged 30, has stated repeatedly that he aims to serve as Le Pen's prime minister rather than succeed her. Still, the chance that Le Pen may ultimately withdraw could thrust him into the contest.

Surveys have long indicated both individuals as likely contenders for a presidential runoff. Certain recent polls have even hinted that Bardella might surpass Le Pen in the opening round.

Le Pen's conviction arises from accusations that National Rally members diverted European Parliament funds meant for parliamentary aides to instead compensate party employees in France. Judges in 2025 determined Le Pen held a central position in the arrangement, a conclusion she has always rejected.

The initial verdict drew sharp criticism from Le Pen's supporters in France and overseas, who charged the judiciary with interfering in democratic processes. Her critics maintained that public officials must face identical legal accountability as ordinary citizens.
