Former Supreme Court justice Yosef Elron notified the High Court of Justice that the parliamentary process electing attorney Michael Rabello to the state comptroller position breached legal standards, aligning with primary claims in challenges to nullify the outcome.

Elron submitted his stance within a preliminary reply to the filings contesting the June 3 ballot. He refrained from seeking his own appointment as comptroller in place of Rabello and avoided requesting installation in the position. Instead, he participated as a respondent and endorsed the petitioners arguments regarding the unlawfulness of the second Knesset ballot.

He further supported the remedies sought by the petitioners, such as nullifying the election results.

The submission remains concise yet carries weight. Elron, defeated by Rabello during the runoff, now formally advises the court that the procedure electing his rival constituted not only political misstep but outright illegality.

Rabello, who serves as Prime Minister Benjamin Netanyahu personal counsel, secured the comptroller post following an intense and contested plenum vote. During the initial round Elron obtained 60 votes while Rabello secured 57, with neither reaching the required threshold of 61.

A subsequent round followed yet faced interruption when opposition members claimed coalition representatives received directives to record their selections behind the voting screen, contradicting the secret ballot requirement for the comptroller position.

Following resumption of the process Rabello prevailed with 61 votes against Elron 57.

The dispute has escalated into one of the most intense legal and political conflicts over a key oversight appointment, given the comptroller mandate to review government operations and public entities. The position holds particular importance now as the incoming official will address institutional consequences from the October 7 events and ongoing conflict.

The filings emphasize that vote confidentiality represents more than procedural detail, functioning instead as vital legal mechanism permitting MKs to decide independently absent political coercion, intimidation, incentives or party discipline.

Petitioners contend that alleged recording transformed the confidential process into a test of allegiance. Certain filings asserted that such documentation assigned transactional character to the ballot and compromised overall election validity.

Petitioners maintain this step failed to rectify the issue since claimed coercion and documentation persisted in tainting the outcome.

The Knesset and Rabello have resisted the filings, partly contending that petitioners approached the court prematurely without pursuing alternative remedies and that the facts presented remain partial and inaccurate.

The High Court scheduled a hearing for June 18. The petitions additionally request temporary measures to block Rabello from swearing allegiance and assuming duties pending judicial decision. Current Comptroller Matanyahu Englman concludes his term early in July.

The court must now determine if the claimed secrecy breach warrants overturning one of parliament most critical appointments.
