Sexual assault victims and survivors of prostitution appearing before National Insurance Institute medical panels can request targeted accommodations. Options include evaluation by a female physician, participation via video link, or in select situations review of the case solely on submitted documents without an in-person appearance.

The Jerusalem Regional Labor Court approved these measures in a ruling issued on Tuesday and released publicly on Wednesday.

Four individuals who had experienced sexual assault or prostitution, represented by the Justice Ministry Legal Aid Department, initiated the case. They contended that the NII medical appeals process lacked adequate adaptations for those dealing with sexual trauma.

Medical panels often serve as a required step toward obtaining disability benefits or other social entitlements. For survivors of sexual assault the procedure can prove particularly challenging.

It may involve discussing deeply personal trauma, facing questions from physicians, or participating in a formal session that feels overwhelming or retraumatizing.

The appeal highlighted that while some adjustments were offered during initial medical panels, they were inconsistently applied at later stages when individuals challenged prior decisions before higher committees.

After the proceedings the NII, Health Ministry and additional government entities reached agreements to improve sensitivity toward survivors of sexual trauma.

New Framework Aims to Improve Access for Survivors

Under the updated framework the NII will flag internal records when an individual scheduled for a medical committee has a history of sexual assault. This marking allows the case to receive more attentive handling.

When a person requests a female doctor on the panel the NII will seek to fulfill the request subject to availability in the relevant specialty and location.

In appropriate instances the committee may also permit video hearings or base decisions entirely on medical records without requiring physical attendance.

These adjustments cover medical appeals committees handling general disability, work injuries, victims of hostile acts and disabled children.

The case has additionally spurred planned enhancements to training for physicians serving on NII panels.

A professional committee established by the Israel Medical Association advised incorporating instruction on sexual trauma and other trauma types. Health Ministry Director-General Moshe Bar Siman Tov endorsed the recommendations, with the new content scheduled for inclusion in physician training programs starting next academic year.

The curriculum will cover recognition of trauma indicators, sensitive questioning techniques, trauma-informed physical exams and respectful communication with applicants.

Judge Rachel Barag-Hirshberg endorsed the agreements and rendered them obligatory. She observed that the petitioners had endured sexual assault and prostitution yet mustered the resolve to pursue their social rights through the NII.

Prior to closing the matter the judge noted that the participating bodies had recognized the value of tailored approaches for sexual trauma survivors to facilitate access to fundamental social benefits.

Improved Outcomes for Victims Expected

Legal Aid Department head Nochi Politis stated that the decision underscores the value of coordinated efforts by public agencies to center crime victims in their processes.

The creation of specialized responses supports fairer proceedings and stronger outcomes for victims, she said. The department provides representation to sexual assault victims free of charge and without income testing beginning at the complaint filing stage.

Att. Yael Kasten-Rabsky, who leads the NII practice within the Legal Aid Department, described the outcome as advancing a more accessible, sensitive and adapted framework for survivors of sexual trauma.

Att. Anat Rubio-Kimmelman, who represented the survivors alongside attorney Nava Eilon, noted that permitting examination by a woman can prove decisive.

She explained that many survivors cannot or will not communicate openly with a male examiner due to post-traumatic stress yet previously lacked genuine alternatives.

The challenge intensified following the October 7 attacks, which presented professionals with particularly severe cases. With enhanced training and accommodations survivors should gain a fairer opportunity to present their claims and obtain entitled rights, she said.
