Oracle (NYSE: ORCL) has made a substantial wager. As one of the top providers of AI computing resources, the company is investing billions to maintain its lead.

Oracle plans to allocate over $90 billion to AI infrastructure in fiscal year 2027. Roughly $40 billion of those costs will be covered by new debt and equity. This scale of spending has unsettled investors, and there is a major factor that could prevent the AI bet from succeeding: state laws.

Lawmakers nationwide are heeding public input and resisting the data center expansion. Worries over power grid limits, water availability, and higher electricity rates have prompted fast-moving legislation.

This has led to possible fees for tech firms in places like Wisconsin, along with full pauses in New York and Maine. Fifteen states are weighing bans on data center growth, while more than 40 states have introduced assorted rules.

This regulatory barrier is one Oracle cannot address through expense reductions. State rules represent a genuine constraint that may also add significant costs.

Oracle is cutting expenses where possible and recently revealed plans to lay off 21,000 workers. Those cuts could generate up to $10 billion in savings. Still, that sum is small next to the planned outlays and the potential losses if data center opposition spreads further.

Investors could see slower growth ahead, which would make the proposed AI spending tougher to defend. Oracle shares have dropped 35% in 2026 and 47% over the past 12 months. Until AI firms reach agreements with states, existing shareholders should stay patient during this uncertain phase. Those considering entry should observe how regulations develop.
