Democratic lawmakers in North Carolina put forward three constitutional amendments this week designed to safeguard the governor's traditional powers and improve oversight within the court system.

The push came partly in response to investigative reporting that uncovered how Republican lawmakers had enacted multiple measures over nearly a decade to reduce the authority of the state's Democratic governors.

During a Wednesday press conference, the sponsors of the bills noted that passage is improbable in the current session given Republican control of both the House and Senate.

By framing the measures as constitutional changes, the eight Democrats aim to shield them from ongoing partisan conflicts in the closely divided state.

Rep. Phil Rubin, who sponsored one bill, stated that Republicans will not hold the majority forever and will likely appreciate such rules when out of power, making it wise to enact them now.

Leaders from the Republican side in the House, Senate, and court system offered no comments on the proposed legislation.

Analysts have observed that these Republican-led shifts have overridden voter preferences by limiting the Democratic governor's influence over various boards and executive functions, resulting in the weakest gubernatorial role nationwide. Republican officials have countered that voters also chose a GOP legislative majority.

Rubin's proposal would prevent further reductions in gubernatorial powers and end what he termed government by ambush, where major bills appear without prior notice to the minority or public.

Rubin highlighted that recent reporting illustrates the risks of lacking such protections, allowing voters to strengthen the constitution, insist on full transparency in lawmaking, and ensure public input prevails over private negotiations.

The remaining two amendments focus on the judicial branch.

One, from Rep. Marcia Morey, would open disciplinary hearings and penalties by the Judicial Standards Commission to public view.

Current GOP policies keep the commission's activities confidential. Reporting showed that the Republican-led Supreme Court privately rejected recommendations to publicly reprimand two Republican judges who had admitted to serious violations.

Morey's bill would also alter appointment processes for commission members to avoid potential misuse of its authority.

At present, Republican legislative leaders and Chief Justice Paul Newby select most members. Reporting noted that in 2023 Newby urged an investigation into a Black Democratic justice who had questioned his move to end a racial equity panel.

The measure would split appointments evenly among the chief justice, the governor, and the North Carolina State Bar, which Morey said is essential for a fair and effective process.

The final bill, from Rep. Deb Butler, would bar Supreme Court justices from cases involving family members as parties. Justice Phil Berger Jr. has drawn scrutiny for participating in matters where his father, the Senate leader, is a defendant in his official role.

Butler's proposal would also require justices to reveal more details on major stock trades, external income, and sponsored travel. An investigation found that Newby had not disclosed a trip to a high-end Hawaiian resort funded by a conservative judicial program.

Butler presented the bill as a way to rebuild public confidence, noting that citizens should trust the court's integrity fully.

If the bills somehow advance, voters could decide on them in November. Otherwise, the sponsors plan to reintroduce them next session, when some Republican strategists anticipate a possible shift in House control.

Morey affirmed their dedication to pursuing these changes to promote fairness in the courts and legislature, emphasizing that impartiality should be standard rather than partisan influence.
