A class action antitrust lawsuit has been filed against TDK Corporation, Hutchinson Technology Inc., Magnecomp Precision Technology Public Co., Ltd., Magnecomp Corporation, and SAE Magnetics (H.K.) Ltd., along with NHK Spring Co., Ltd., NHK International, NAT Peripheral (Dong Guan) Co., Ltd., NAT Peripheral (Hong Kong) Co., Ltd., and NHK Spring (Thailand) Co., Ltd. This notice applies only to the Reseller Plaintiffs, which include Now Micro, Inc., Integrated Technical Systems, Inc. d/b/a Network One, It Worx, Inc., Stephen Arvay, and Michael Medeiros. The complaint alleges that the defendants conspired to fix prices for suspension assemblies, a key component in hard disk drives used in laptops, desktops, and servers. The Reseller Plaintiffs purchased and resold these drives, claiming that inflated costs were passed along from manufacturers.

The Court has certified a Reseller Class consisting of all persons or entities in the Indirect Purchaser States, excluding original equipment manufacturers, who bought a Standalone Storage Device or Computer for resale from January 2003 through May 2016 that contained suspension assemblies made or sold by the defendants or their co-conspirators, or who indirectly purchased such assemblies for resale.

The Court has not ruled on the merits of the claims. No funds are currently available, and there is no assurance that any will be. If you fall within the Reseller Class, your rights are impacted and you must decide how to proceed.

Reseller Class members who wish to preserve the option of receiving any future payments or benefits need take no action at this time. By remaining in the class, they will receive notice of any recovery and how to claim a share. Those who do nothing will be bound by all court orders and judgments and will be unable to pursue separate litigation on the same claims.

Individuals who prefer to file or continue their own lawsuit against the defendants on these claims must request exclusion from the Reseller Class by the deadline of September 2, 2026. Those who opt out will not share in any recovery but may pursue independent action and will not be bound by the class action results.

Class Counsel must establish the claims at trial, which has not yet been scheduled. A jury and judge will evaluate the evidence to determine the outcome, with no certainty of success or recovery for the class.
