Andrew Left's legal team mounted an aggressive defense in his securities fraud trial on Friday by questioning a federal official about the decision to target the short seller rather than the company he had criticized for misconduct.

Left, a well-known short seller famous for positions in stocks such as GameStop and frequent media appearances, stands accused of market manipulation and misleading retail investors while profiting more than $20 million.

One firm cited in the allegations is Namaste Technologies, a Canadian cannabis entity that traded over the counter in the United States under the ticker NXTTF. Left issued critical tweets and reports via Citron Research in late 2018, claiming the company engaged in fraud.

His defense maintains that Left correctly identified problems at Namaste.

During cross-examination of postal inspector Anna Hallstrom, who participated in the probe, counsel suggested authorities had gone after the whistleblower instead of addressing the underlying issues.

Eric Rosen, representing Left, highlighted what he described as questionable conduct by Namaste, such as promoting a pledge event that promised investors a chance to meet Snoop Dogg in Montreal after holding shares for 90 days. He also noted concerns about the CEO, who was eventually dismissed.

Rosen observed that after Left publicized the accusations, regulators took no action to halt the alleged scheme.

Namaste surfaced again in testimony the prior day when retired firefighter Billy Banks stated he had lost several thousand dollars investing in the company following Left's negative commentary and the resulting share price decline.

Rosen asked Hallstrom whether individuals like Banks deserved protection and whether regulators had failed to intervene. Hallstrom replied that she did not know why no action occurred.

Rosen further inquired if exposing potential fraud online benefited the public by preventing losses in questionable investments. Hallstrom agreed research helps but added that trading tied to a larger deceptive plan crosses into misconduct.

The exchange highlighted a key dispute: Left's side insists he published sincerely held assessments that often proved accurate, while prosecutors contend he concealed trading intentions and acted inconsistently with his public statements.

The defense position aligns with arguments often made by activist short sellers that their work serves markets by revealing problems.

Rosen questioned whether potential investigators would avoid exposing similar issues if trading restrictions applied to accurate disclosures. He noted Namaste shares later fell near zero before the company rebranded as Lifeist Wellness Inc.

The government's core claim regarding Namaste centers on alleged coordination with Anson Funds to prepare reports in exchange for trading profits without disclosure. Left's team responds that no law barred such collaboration.
