The situation draws attention as allegations surface that someone may have taken proprietary information from Apple.

This story carries irony for the technology leader, which has encountered comparable situations before.

Apple's major legal action against OpenAI claims the ChatGPT developer ran a targeted effort to hire Apple engineers, pull out private details, and apply the company's trade secrets to advance its hardware goals.

The claims stand out yet echo past events.

Apple has dealt with lawsuits from other firms that described nearly identical approaches: drawing away important staff and then applying their insights to create rival offerings.

Masimo's allegations

A notable example involved medical device company Masimo. Its 2020 lawsuit stated that Apple first considered a collaboration then hired several senior executives and engineers skilled in pulse oximetry methods.

Masimo asserted Apple applied private expertise from these hires to create the blood oxygen feature in the Apple Watch. Apple rejected the theft claims and maintained it simply brought on skilled individuals who built the technology on their own.

The matter grew into several trade secret and patent disputes plus an International Trade Commission review.

A separate patent claim by Masimo against Apple resulted in a 2023 import restriction on the Apple Watch. In 2025 a jury found Apple had violated Masimo patents and required payment of 634 million dollars. The restriction was later lifted.

The A123 matter

Battery firm A123 Systems raised comparable points earlier. It claimed Apple methodically recruited members of its advanced battery group, including a former chief technology officer, and gained from private battery research.

Apple rejected any misconduct and the matter resolved before trial.

Neither situation ended with a clear court ruling that Apple had taken another firm's trade secrets. Yet both show a common Silicon Valley pattern where firms charge competitors with moving past normal hiring into the use of protected information.

In California workers can change jobs freely and join any new employer. For large technology companies this freedom brings challenges since departing experts carry valuable expertise that prompted their recruitment in the first place.

The point at which such moves become trade secret misuse remains unclear.

Earlier no solicitation agreement

Apple has shown strong opposition to open talent movement in Silicon Valley. During the 2000s it joined a confidential arrangement with five other technology firms including Google and Intel to avoid direct hiring from one another as revealed in a Justice Department case.

The firms paid over 400 million dollars to settle a related class action suit according to reports.

Key departure

With that arrangement ended Apple staff gained more mobility. In 2019 prominent designer Jony Ive departed to launch io Products alongside other former Apple team members.

OpenAI later acquired io and added Ive along with his group including cofounder Tang Tan. They are now creating a consumer device that could rival the iPhone and offers stronger AI capabilities than current Apple products.

Apple's lawsuit against OpenAI spanning 40 pages makes no direct mention of Ive aside from footnote URLs containing his name.

This omission appears notable. An accusation of hiring top leaders and misusing their knowledge of trade secrets might be expected to reference such a prominent figure.

Additional former Apple employees who joined io or moved directly now work at OpenAI. The lawsuit names two: Tang Tan an io cofounder and Chang Liu.

Company facing new competition

The current case reflects a large technology firm encountering direct pressure from a well resourced newcomer using innovative technology.

When established companies feel stable they often hire from smaller competitors who then allege their ideas or expertise were taken. When those same firms face challenges from ambitious entrants they become strong protectors of trade secrets and private data.

Apple appears to have reviewed its records and identified a few former staff who may have carried ideas to OpenAI.

Do these steps amount to trade secret theft or represent employees using their right to choose new roles while carrying their knowledge? Apple made the latter argument in the Masimo dispute.

The court will determine whether the claims against OpenAI hold. The conflict illustrates a standard industry reality that today's accuser was often yesterday's defendant.
